1.a) This Membership Agreement is entered into between Burcu Kocabaş and the "Member," and governs the terms under which the Member may benefit from the services offered on the website www.burcumay.com, operated under Burcu Kocabaş.
1.b) Burcu Kocabaş and the "Member" shall each be referred to individually as a "Party" and collectively as the "Parties."
2.a) This Agreement sets out the general terms of use, rules, conditions for Member access, and legal responsibilities applicable to the website www.burcumay.com, owned by Burcu Kocabaş.
2.b) Under this Agreement, the Member wishes to register on the e-commerce platform at www.burcumay.com, managed by Burcu Kocabaş, and to purchase products and/or services available in the Virtual Store on this platform.
2.c) To establish a contractual relationship between the Parties, the Member must complete the required registration fields on www.burcumay.com, set a password, and provide the specified consents and permissions. In case of any incomplete information, the Member may contact customer service or update their details via the website. By accepting this Agreement, the Member acknowledges that www.burcumay.com bears no responsibility for any issues arising from incomplete information.
2.d) The Member confirms that all personal and other information provided during registration is accurate. The Member accepts that Burcu Kocabaş bears no responsibility if such information is inaccurate, and that the Member is solely liable for any damages arising from providing false or outdated information.
2.e) The Member acknowledges that any legal transaction or purchase process initiated through the website requires full compliance with all applicable legal obligations and procedures, and that Burcu Kocabaş bears no responsibility or knowledge regarding such obligations.
2.f) All credit and debit card transactions made by Members on www.burcumay.com are processed online directly between the Member and the relevant Bank, Credit Institution, and/or Payment Service Provider. None of these transactions are processed or approved by www.burcumay.com. Accordingly, www.burcumay.com does not view or store payment credentials unless the Member explicitly consents to saving card details for faster checkout, in which case www.burcumay.com is responsible for protecting such data under the terms of this Agreement.
2.g) The Member agrees to act in accordance with the provisions of this Agreement, the terms stated on the website, applicable legislation, and ethical standards in all transactions and communications on the website. The Member bears full legal and criminal responsibility for their actions on the website. www.burcumay.com may share Member information with authorized authorities when required by applicable law.
2.h) Burcu Kocabaş takes reasonable measures to keep www.burcumay.com free from viruses and malicious software. However, Members are responsible for obtaining their own virus protection. By accessing the website, the Member accepts responsibility for any errors or damages that may occur to their own software or operating systems.
2.i) Each Member may hold only one account. If multiple accounts are detected, www.burcumay.com reserves the right to close and/or suspend duplicate accounts without prior notice. Any benefits obtained through multiple accounts will not be protected, and repeated violations may result in termination of membership and/or other legal action.
2.j) www.burcumay.com is not liable for any direct or indirect damages arising from access to or use of the website, its content, data, or software, whether based on breach of contract, tort, or any other grounds. The Member accepts this limitation by agreeing to this Agreement.
2.k) The Member's username and password are created by the Member and are entirely the Member's responsibility to keep secure and confidential. The Member accepts full responsibility for all transactions carried out using their credentials and may not claim that such transactions were performed by another party.
2.l) www.burcumay.com reserves the right to modify any services, products, terms of use, or information on the website, to reorganize the site, or to suspend publication at any time without prior notice. Changes take effect immediately upon publication. Continued use of the website constitutes acceptance of such changes.
2.m) In the event that a Member engages in any act constituting a crime or offence under Turkish Penal Code No. 5237 or other applicable legislation, or obtains any unlawful benefit through www.burcumay.com causing damage to the company, www.burcumay.com reserves the right to claim full compensation for all resulting losses — including loss of profit, administrative and judicial fines, third-party claims, court costs, taxes, and all other expenses — without any prior notice or third-party consent.
3.a) No material on www.burcumay.com — including images, graphics, logos, code, and software — may be modified, copied, reproduced, translated, republished, uploaded, posted, transmitted, or distributed without prior written permission and proper attribution. No part of the website may be used on another website without authorization. Violations will result in legal and criminal liability. All rights not expressly stated herein are reserved by Burcu Kocabaş. Any infringement of Burcu Kocabaş's intellectual or industrial property rights by the Member shall entitle Burcu Kocabaş to claim compensation for all direct and indirect damages, present and future.
4.a) www.burcumay.com is committed to processing, securing, and protecting personal data shared by Members in accordance with Personal Data Protection Law No. 6698 (KVKK) and other applicable legislation. The Member freely and explicitly consents to the collection, use, transfer, and processing of their personal data within the scope of this Agreement. Burcu Kocabaş may contact the Member via letter, email, SMS, phone call, or other means using the contact details provided during registration, for communication, marketing, and notification purposes, unless the Member provides a written objection.
4.b) As referenced in Article 2.g, www.burcumay.com may share Member information with authorized authorities when required by law. The Member consents to such use and storage of their personal data. www.burcumay.com will take all necessary technical and administrative measures to ensure the secure storage of personal data and to prevent unauthorized access and unlawful processing, in accordance with Article 12 of Law No. 6698. The Member retains all rights granted under Article 11 of Law No. 6698, including the right to access, correct, and update their personal data at any time.
5.a) A Party that is unable to fulfil its obligations under this Agreement due to a force majeure event shall not be held liable. Force majeure shall be determined in accordance with Turkish Code of Obligations No. 6098 and Articles 2 and 3 of Turkish Civil Code No. 4751. A Party affected by a force majeure event shall not be held responsible for delayed or prevented performance, and such failure shall not constitute a breach of this Agreement.
6.a) Upon completing the registration process, the Member is deemed to have accepted all terms set out in this Agreement, and the Agreement enters into force immediately. The Agreement shall automatically terminate — without any notice required — upon the expiry of the membership or upon the occurrence of any of the termination events specified herein.
